Legal Question in Real Estate Law in Pennsylvania

My ex girlfriend and I bought a house together. we split up 5 years ago and then she quit her job and stuck me with all the bills. Because she hasn't paid for any of the mortgage and hasn't taken her name off the deed can I legally make her pay me back 50 percent of what I paid on the mortgage and the real estate taxes from the time she stopped working

Thank you for your question. If you are both on the deed and you have been paying the mortgage note for the last 5 years, you certainly can demand 50% of what you have paid over the last 5 years. Keep in mind, however, if you rented the property to a tenant and collected rent during those 5 years, she is still liable for 50% of the mortgage note, but she can demand 50% of rentals received from the tenant during the times it was rented. If, on the other hand, you did not rent out the house, but occupied it as your residence, you can still charge her for her share of the mortgage Note, but she can demand from you one-half of the fair rental value.
