You asked about jail for speeding.

Anyone can be put in jail for any crime. A crime is any unlawful activity which is carries a penalty with potential imprisonment. Many speeding violations are therefore jailable offenses.

The United States Constitution guarantees us the right to reasonable bail. But bail is determined by the severity of the offense and the likelihood of the offender making the appearance.

In many states it is policy not to jail in-state residents when speeding charges are not excessive. The threshold is often lower for out of state residents. As a rule, any time a person is pulled over for doubling the speed limit they can expect to take a vacation.

Also, combined speeding offenses, such as careless operation or racing will often result in jail time before bail.

Roger
