Legal Question in Traffic Law in Pennsylvania

I received a speeding citation for driving 15 mph over the speed limit (50 mph in 35mph zone). This is my first speeding citation since I began driving 9 years ago. So I have 2 questions:

1. The police officer wrote the incorrect zip code on my ticket. Instead of my zip code, he wrote the zip code of the office that he works out of. Does this make the ticket inadmissable at all? Should I bring this point up in court?

2. The police officer suggested that if I had a clean driving record, which I do, that I plead not guilty and go to court to have the fine and points on my license possible decreased. Do you suggest this?

Thanks for you help!

I would think the best option is to plead not guilty and go to court. A plea bargain is a good possibility as indicated in number 2 of your question.

Philadelphia Traffic Court is a unique place....a lot of what happens there depends on which Judge you see. Some are "nicer" than others when it comes to pea bargains. All of them are required to inform you that you have the absolute right (after paying a small fee) to appeal their decision to a "real" Judge at the Court of Common Pleas, which, unfortunately, many unrepresented people are forced to do ( which I see as a waste of time and money ).

Having a lawyer does help. Not only in the eyes of the Court (you took it serious enough to bring a lawyer ) but also in terms of time and stress. Attorneys go first and will handle all the problems there. Without a lawyer expect to spend 1/2 a day.

Hope this helps. Feel free to write back or call with other questions or comments!

Mike
