Legal Question in Traffic Law in Pennsylvania

State PA: My son has just been cited for 3361 (Driving at safe speed) - actually of course at an unsafe speed. This was the result of skidding and ending up in a show pile. I'm trying to discover if there is any defense against something like this or is the fact that there was an accident proof of the infraction. If it's relevant, he was actually doing under the speed limit and the cop who arrived minutes after the impact didn't ask him if he had been drinking or anything. Airbags did not deploy. I'm trying to discover if there is any point in him attempting to fight this, or if it will be a waste of everyone's time.

Chances are, if you explain the situation to the Officer at the Court, he may reduce the ticket to 3111(a) a no point offense......Get there a little early and tlak to the officer--you may want to hire a lawyer to help you with that,,,,,Removing the points can keep your insurance rates down..
