Legal Question in Wills and Trusts in Pennsylvania

Brother will not show will

My father died a few weeks ago. My brother lived with him in my fathers house. He has a copy of his will and refuses to show it to anyone. He claims he was left everything and myself and sister was left nothing. He already took most of my father's money and I am worried if we are left anything he is taking it now including the contents of the house. How do we get the will and see if we are left anything and how do we stop him from taking things out of the residence?

Re: Brother will not show will

You need to run, not walk to an attorney. You can force production of the Will by filing with the Register of Wills for a Will Production. The problem is you don't want your brother to run off with all of the money in the meantime. If he is taking the property and has no right to it, it is theft and if he is the executor of the Will then he is breaching his fiduciary duty and can be removed as Executor and can be forced to pay everything back.
