individual retirement account

Does an individual retirement account ("IRA") have be probated in the estate even if beneficiaries are named? Does the IRA have to become part of the estate?

Yes and no. The IRA is a part of the estate because it is something the deceased owned at the time of his or her death. It is included in all calculations for tax purposes and listed on the accounting.

The IRA itself is not probated, only wills are probated. But, you still go through the process with the IRA along with all of the other assets.
