Legal Question in Criminal Law in Rhode Island

Disorderly Conduct Charge

Last night I took shrooms, I got lost, freaked out and almost got hit by a car. The cops came and arrested me, I didn't have anything on me but they charged me with disorderly conduct, however they knew I was on shrooms. I've never been charged with anything in my life outside of a speeding ticket and I'm 20. Should I get a lawer, how serious is this?

Re: Rhode Island Disorderly Conduct Charge-Criminal law-

This is an alleged crime so you should take it seriously and retain a Rhode Island (RI) Criminal Law Lawyer. Despite the fact that it is a serious matter, in the general area of criminal law disorderly conduct is a relatively minor offense.

The fact that you were on drugs in itself does not constitute disorderly conduct, in my opinion. You should consult with an attorney/ lawyer because you may decide to fight the charges.

You may also be eligible to get the case dismissed for lack of evidence. You may be eligible for a filing which means that if you stay out of trouble for a year the case is eligible to be expunged. One year filings are mostly for first time offenders

However, be careful becuase a one year filing in Rhode Island can have serious implications if you are charged with a new offense during the one year.

A person with a filing could spend a couple of weeks in jail if they are alleged to have committed a new offense during the filing period.

You should also consult an attorney because you do not want to end up with a criminal conviction on your record or another unfavorable result such as probation or suspended sentence.

You also want to consider what plea options may be offered and whether the charges could be expunged sometime in the future to clear your record.
