i would like to know in what would it affect me or my child the fact that his father whants to give him his last name but the father is an imigrant?

Do you mean his father is an illegal immigrant? Are you married to a father?

Usually, it doesn't really make difference. It's a right of the parents to choose the name for their child. Parents can also choose whose last name (or both names) to give their child. If a father is illegally in USA (and potentially deportable) and you are not married, then you might have reasons to seriously consider the name you give to your child.
