Legal Question in Personal Injury in Rhode Island

punched in mouth by brother

Hi, I was punched in the mouth by my brother on Nov 15 2002.

I have had severe jaw pain and recurring incidents of muscle

spasms. I went to the hospital that day for treatment. He was charged by the police in Pawtucket, the hospital called the police on my behalf. It has been disposed of in family court. Now 4 years later, I am still having issues with my jaw and at times I am not able to eat properly, it hurts to sneeze and yawn. Is there any civil action that can be taken at this point? Thanks. Caron

Re: punched in mouth by brother

Unfortunately, you did have a cause of action but it expired on November 15, 2005. In the state of Rhode Island the statute of limitations on any personal injury action such as an assault is three years from the date the action accrued. Consequently, you had to file a lawsuit against your brother by November 15, 2005.
