Legal Question in Family Law in South Carolina

divorce decree not honored

My ex and i divorced in 2005. The divorce decree said that my name be removed from her car. She did not do that and the car was repo'd. Is there anything I can do to get this charge off removed from my credit report seeing as how the decree stated that i was not supposed to be responsible for that vehicle before the repo?

Re: divorce decree not honored

The creditor is not bound by the provisions of your Divorce Decree, so that's not much of an option. You may be able to have her held in contempt for her failure to comply with the requirements of the Order with regard to removing your name from the vehicle.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
