Legal Question in Family Law in South Carolina

divorce settlement

In a divorce settlement, is it reasonable or standard practice to include a spouses

(in this case, the husband's) projected retirement income. The husband has a state retirement projected income of $3,100 per month and is 48 years old. The opposing attorney has represented this as $3,100 X 12 months X 26 years (his projected remaining lifespan) = $967,200 / 2 or $483,600?

Re: divorce settlement

As with answering most legal questions, this one requires me knowing a considerable more amount of information. Many things have to be known, such as the length of the marriage, the financial contributions towards the marriage of each spouse, each spouse's current individual financial condition, the portion of debt allocation, the grounds for the divorce, etc. There are just way too many things that have to be considered. If you are talking about that much money, I certainly hope that you are represented by legal counsel. If you are not, you are free to call for more information at: 843-828-1137, or 888-789-8100
