Legal Question in Family Law in South Carolina

I am currently divorced and have a 16 year old son. My Ex and I have shared custody and should my son should be staying with him more since he doesn't pay child support. My son says he wants to live with me almost 90% of the time in which he basically does now.

Isn't he old enough to decide now to whom he wants to live with? If so, how do I get the divorce documents to become no longer valid?
