Family law

What exactly is abandonment, what does it do, and how do I file for it? Also, does common law marriage really exist in South Carolina and if it does, does the couple need a divorce if they decide to seperate? How do I know if I am in a common law marriage?

Desertion is still a ground for divorce in South Carolina, but it is hardly ever used because the theory is antiquated and it is typically more expensive than other methods. Common law marriage does exist in SC, and if you are married (common law or otherwise), then you will need to divorce to end the marriage.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
