if my husband committed adultery and was gone 9 months, is it thrown out the window if he stayed at my house but slept in a separate bed and i have a witness to prove it?

If he argues and can prove that you reconciled, then his adultery would likely be deemed forgiven. However, if you have a witness or witnesses that you have not reconciled, then he may not be able to prove the necessary elements to use that against you.
