My son deserves better than THIS
I would like to know what I can do about getting my 6yr old son back. He is with his dad @ present time. I have joint custody, placement with dad. I am the Mother. I see him 1 day/wk and everyother wk-end. He is performing badly in school. What can I do. Thank You

As a rue of thumb, there must be some change in circumstances which occur after the final custody order and which justify a change in custody in the best interest of the child. My gut reaction is that your complaint of "not doing well in school" at the age of 6 is not significant to justify a change in custody. All children hate the situation of divorced parents. The way you and your ex-spouse behave toward another may be the cause of the poor performance. However, there may be other things at work here that you have not listed in the short question. Seek professional advice; see a lawyer.
