Legal Question in Civil Litigation in South Carolina

I hired a realtor to sell my home. She said she wanted me to put a ton of money in it so she would be able to sell it. I didn't have it so she said she will loan it and when the house sells she will get it back then. Well she has had it listed over a year now. When the listing expired I decided to go with another realtor. So she is ok with it but now all of the sudden she is in financial trouble and is demanding that I pay her. The house still isn't sold. At one time I offered her $1000 and payments but she refused. Now she wants to put a judgement against me. Nothing is in writing. Can she sue me?

Yes, she can sue you. You agreed to the loan. You benefited from the loan. What will happen is the she will get a judgment against you and you will have to pay her judgment off when your house sells. This will happen at closing. I suggest that you offer to sign a confession of judgment. This way you will not have to pay for any court costs or attorney fees.
