My girlfriend from Jamaica has overstayed her visa. If we get married will she be able to get a green card and not be deported?

Hi,

Assuming that you are a U.S. citizen, upon marriage your wife will be able to adjust status within the U.S. without having to depart the U.S. since she initially entered the U.S. on a visa, even if it subsequently expired: www.h1b1.com/Uscitizen.htm

So long as the marriage is not solely for an immigration benefit, the type of visa permits adjustment of status, she is not otherwise inadmissible and you are a U.S. citizen. Perhaps now is the time to hire a lawyer.
