Legal Question in Intellectual Property in South Carolina

I started my LLC company in 1996, we closed because of family illness. Recently I found that my company name is being used in another state is there anything that can be done about this?

As a Franchise Attorney I can say the following. There is probably nothing you can do since the other company is doing business in another state - unless you did a federal trademark registration, which would have given presumptive legal rights in all states. More importantly it appears you abandoned any rights you may have had by closing the LLC. Consult with a good business or franchise attorney in your area for specific advice.
