Legal Question in Military Law in South Carolina

Army Basic Housig Allowence

A few months before my x-husband and seperated, he joined the Army. The Army gave us a Basic Housing Allowence for my bills as soon as he started training... A few months after joining the army, we legally seperated, and the BAH was suppose to sop, because he legally didn't have to help withbills but instead start paying child support. a year and a half later, I just found out he has not told the army we are divorced and have been seperated for almost two years... So therefore, he is still gettng the BAH of $800 a month and keeping it for himself. Isn't that defrauding the govcernment? A total of $14,000 he has kept that should have stopped... What should I do???

Re: Army Basic Housing Allowence

You need to notify the military as soon as possible. This will in turn set off a chain of events that the government will require repayment of this money. You possibly could use an innocent spouse defense against any potential claims against you.

If you have further questions about this contact competent counsel in your jurisdiction.

Good luck!
