Legal Question in Personal Injury in South Carolina

Liability of Injury

If a company rents out equipment, are they liable for injuries that result from the equipment being defective? Even if the person who rented the equipment signed a contract that stated they will not hold the company liable for any damage or injuries? I'm wondering, basically, if that's one of those things that's just put in contracts to be used as scare tactics, to limit the number of lawsuits. Or if the company actually is ''off the hook'' for those injuries.

Re: Liability of Injury

The clause you describe may or may not be effective, but you may have a claim against the manufacturer of the machine either way. I would be happy to consult with you.
