Legal Question in Personal Injury in South Carolina

Sued 15 months after a minor car accident

In April of 2001, I was involved in a minor car accident and was sited for improper lane change. My car ended up being hit in the drivers side door by the front right side of the car in the adjacent lane. I was third in a line of cars at the red light, feet on the brakes, and attempting to merge into the left lane. WE moved to a parking lot, the officer checked for damage, he checked for injuries when he arrived. The officer wrote his report. He stated she that they did not complain of injuries and there appeared to be none. We appeared in court a month later. Myself, the officer, and the plaintiff went infront of the judge. I acknowledged my fault and my fine was cut from 250.00 to 80.00. There was no complaint of injury then. I have not heard anything from anyone reguarding the accident until 7/16/2002. I am being sued now for great physical harm specifically to the neck and back, mental anguish, emotional stress and present and future medical bills and lost wages, by both driver and passenger. None of the passengers in my car which was impacted were injured. No airbags were deployed. No contact by letter or phone was made. Is it possible to sue for this after 15 months have passed?

Yes. Here in South Carolina a person has three years from the date of accident to sue for personal injury. From the sounds of it though, it doesn't sound like it will amount to much. I'm sure whatever lawyer your insurance company hired to defend the suit can handle it. Good luck.
