Legal Question in Traffic Law in South Carolina

Who's at fault

While on vacation in SC, myself, my fiance, and his brother and sister-n-law were involved in a car accident. My fiance was driving my car, which is in my mom's name and is insured under my parents insurance. Highway patrol responded to the scene. The other vehicle that was involved was driven by an off duty dispatcher. We were never asked our sign of the accident they just went to him got his version and then came and told us what happened. My fiance got ticketed for an improper turn but we believe this is wrong. If we fight this ticket and he is found innocent how will it affect the injured ppl in the cars? Can my fiance's insurance be sued by my parents to pay the medical bills that have accured?

Re: Who's at fault

If he doesn' think he was at fault, then by all means he should fight it. First of all, it would clear his driving record and stop any points from being assessed, assuming he wins of course. Secondly, it has a big impact on the insurance issue. As it stands now, with him being at fault, all claims would go against your mother's insurance. On the other hand, if he is found not guilty, then claims can be brought against the other driver's insurance. You are welcome to call if you would like to discuss your options.
