Legal Question in Traffic Law in South Carolina

What is the procedure regarding whether investigating officers at a traffic acci

I was recently in a traffic accident that the investigating officer immediately tagged as my fault when it clearly wasnt. He went on the testimony of the other driver even though there were two eyewitnesses who had a clear view and saw every aspect of the accident. They stayed to offer their testimony, but he refused to speak to them and forced them to leave the scene before anyone was able to get their name/phone number. I wanted to know if the officer had to get every account before making a decision. Thank you.

I am not aware of any law that requires the police to speak with each and every available witness. However, that is something that you might be able to use against him if you went to trial. Based on what you've said, there's a possiblity that he could be made to look very bad if a jury had to decide your case. Robert Johnston (843) 828-1137
