Legal Question in Traffic Law in South Carolina

ok my husband is in jail for DUS 3rd offense and he got caught two weeks after that ticket for another DUS 3rd offense in another county well his court date was during the time he is serving for the first 3rd offense and i went and checked and they tried him with out him being there for his court date and have given him another 90 days they didnt even give him a chance for repersentation or anything can they do that because we were working on getting a PD or lawyer and this is not fair,

If your husband was in jail when they held his trial, then that is grounds to have the conviction overturned or reopened. I have seen that happen before.
