Legal Question in Bankruptcy in Tennessee

power of attorney

My husband and I are going to file chapter 7 bankruptcy. He is currently deployed overseas for 6 months(military) and I have power of attorney. I want to know if I am able to file since he will not be present to attend the creditors hearing and sign any papers.? if he must be present at this hearing then what should I do-I cannot afford to pay my creditors, so wont they harass me even further if I wait more time until he is able to attend? should I notify my creditors that I am planning to file soon?

Spousal Bankruptcy

You have a problem that may be solvable by doing separate bankruptcies. In other words, file bankruptcy on your debts now (if you have individual debts) and list any joint debts with your husband. When your husband returns, he can file a separate bankruptcy on his individual debts.
