Wage Garnishment for cell phone bill

I live in TN and I owe Verizon $368.00. I am presently 6 months past due, the closed the acct and charged me an early disconnect fee. I got behind and could no longer pay the bill because my 2 yr old granddaughter came to live with me. I now pay $560 a month in childcare alone and have no extra money to pay off this bill. The collection agency they turned it over to said they are going to garnish my wages and take me to court. Can they do this when I am providing sole support for 2 children?

before your wages can be garnished, Verizon will have to take you to court and get a judgment. In the event that happens, you will have an opportunity to file a slow pay motion with the court within ten days of the judgment and let the court decide what you will have to pay. You will be asked to bring a copy of all bills and proof of your income - doing an income and expense statement would be a great idea. So long as the judge makes the decision and you pay what the judge says you will not get garnished. Good luck.
