Mental Health Evaluation

A family member recently pleaded guilty to rape. He did not undergo a mental evaluation before the plea bargain. He should have been evaluated. What is the law on that? He had an attorney and told his attorney he understood, but the family disagrees and feels he should have been evaluated.

Did the family provide the resources for a mental health evaluation? Would it have changed the outcome of the case? Was your family member able to understand the nature of the charges against him, and able to assist his attorney with his defense? Did the family provide his attorney with evidence of a lessened mental state? How long ago was the plea? Have you retained a new attorney to determine if the plea can be withdrawn?
