Statute of Limitations TEXAS ONLY

YOu asked about the statute of limitations on hot checks in Texas. If the value is less than 1500, it is a misdemeanor and the S/L under TRCrimP 12.02 is 2 years from the date of the offense. If it is over 1500 but under 20,000, it is a STate Jail Felony and the S/L under TRCrimP 12.01(6) is 3 years from the date of the offense,

BUT, in Texas, the S/L stops runnning the instant a case if started into the court system by complaint or indictment, and Speedy Trial kicks in, but that is pretty well stopped so long as the state announces ready.

Also, the S/L does not run while the defendant is out of the state.

For felony level, there is a "Value Ladder"1500-20,000 State Jail Felony20001-100000 3rd Degree Felony100001-200000 2nd Degree felony200001- 1st Degree felonyNO ATTORNEY CLIENT PRIVILEGE IS CREATED BY THIS EMAIL, NOR IS ANY INTENDED.

THE RESPONSE HEREIN IS BASED ONLY ON THE INFORMATION SUPPLIED AND GENERALLY APPLICABLE LAW.
