Legal Question in Family Law in Tennessee

Who owns the house?

My husband and his ex-wife got divorced two years ago. He did no change the house title from her name to his before dovorce. However the divorce contract states that his ex-wife has no intrest in whatever he owns. When we tried to change the house title from her name to mine, the title company asked for her (ex-wife) signiture. Well, now she claimes half of the house ($500,000) belongs to her and she dose not whant to sign the papers. Is she going to be able to stop us from selling the house? Is realy half of the house belong to her?

Re: Who owns the house?

I find it almost impossible to believe that a house in the joint names of the parties, worth $500,000--$1,000,000, was not specifically addressed in the parties Marital Dissolution Agreement. You need an attorney to carefully review the agreement and the divorce decree to determine what was intended by the parties and the Court. A provision in the Divorce papers stating that "wife has no interest in whatever husband owns" really does not mean much on its face, particularly when the property is in in the joint names of the parties.
