Legal Question in Family Law in Tennessee

What is Weekend Visitation

After a lengthly battle, my son was awarded weekend visitation with his daughter on the 1st 2nd and 4th weekends, child stays with mom on the 3rd weekend(and 5th if there is one) and he gets optional days that week. My questions is: Is it written any where what day constitutes the beginning of the weekend? For the purpose of counting weeks and determining 3rd and 5th weekends.

Re: What is Weekend Visitation

This is a "pet peeve" of mine. Lawyers and judges will refer to the first weekend (and so on) of the month but will not define it. If Friday falls on the last day of the month, is that the last weekend of one month, or the first weekend of the next month? Generally, I like to define the weekend as beginning on a given night (i.e. Friday) or better yet, a weekend belongs to the month that the Saturday is in. So, in the latter situation if the Friday is in October, but the Saturday is the first day of November, then the weekend is in November and would go to the person who has the first weekend. In any event it should be defined. If it is not defined in the parenting plan, a good idea might be for your son's lawyer to write a letter to opposing counsel and define it and see if that is acceptable and the parties can go by that informally. However, the only way to truly enforce it is to have it be part of the order.
