Legal Question in Medical Leave in Tennessee

"employer" that has less than 50 employees in FMLA

Under the FMLA is a county and/or a county sheriff's department an "employer" within the statute if neither employes more than 50 people? Also is an individual sheriff an employer if less than 50 people are employed by him?

Re: Number of employees

A sheriff is normally a public entity. All public entities, regardless of size, must comply with the FMLA but you must sue the Sheriff individually. I would be more than happy to talk with you, if you want- I'm in Arkansas and I sue in TN sometimes
