Termination Fees

My husband and I terminated our lease 3 months into it.

At the time of the signing we fully intended on staying the full 12 months. The property manager(s) did not witness the signing the secretary did and had no idea what was going on. The property manager will not use the security deposit towards the termination fee as they say the security deposit is non-refundable due to allowing a pet on premise. The lease does not state that the security deposit is non-refundable (this was an oral agreement not placed in the lease at time of signing) and they are now taking us to court over the $300 balance on the termination fee. My question is: can they do this and will the property managers likely prevail or would we?
