if i have a 2nd person on mortgage/deed and they arent paying their part and i am paying all what do i do to get them off deed(is friend not spouse)

Your cosigner can voluntarily deed the property to you through a quitclaim deed which an attorney needs to prepare for you both; however, if your cosigner is not willing to deed the property over, you can file a partition suit wherein the property will be sold and you both split the proceeds. During the partition suit you can be the bidder and buy his interest. Each scenario needs an attorney and our office provides both of these services, please feel free to give us a call.
