Legal Question in Real Estate Law in Tennessee

We found a home that was new construction. Made contract for full asking price, paid significant earnest money and additional amount in upgrades. Closing date kept being pushed back, with no evident move to inspection, appraisal, or closing. Hired an inspector and then structural engineer both of whom found major problems - foundations, drainage issues leading to standing water and mold. Hired a lawyer to help get out of the contract. Homebuilder now will only return earnest money and plans to move on and sell house to someone else. How is he able to do this without disclosing the issues while also stipulating we keep quiet! Our lawyer is pushing us to settle.

If you've hired a lawyer and your paying that lawyer, my best advice is to listen or change counsel.
