Probably both the driver and the employer will be responsible.

The driver will always be responsible for acts of the driver.

The employer/company will be responsible if the accident occurred while the driver/employee was acting in the "course and scope of employment".

You should consult a lawyer for a more in-depth analysis based on the specific facts of your case.

Good Luck!
