Legal Question in Civil Rights Law in Texas

Sex Between Teens

How old apart do kids have to be to have sex? Is two years apart legal? One is 17-boy and the other 15-girl years of age. Does it matter if the girls family files sexual harassment charges? Or will the state prosecute the 17 year old? Both kids stated they agreed to have sex. If charges are filed, what usually happens to the male?

Re: Sex Between Teens

Hi there,

This is a difficult question in the sense that no one wants to encourage underage sexual activity.

However, the legal age to consent to sexual relations is 17 years of age.

Now there is an excetion to this f the parties are within three years of age of one another.

Sincerely,

Erick Platten
