Legal Question in Constitutional Law in Texas

discrimination based on sex

In my current school district, I applied for the assistant principalship. I was granted an interview, as well as two other women. The remaining candidates were men. I was told by one of the members of the committee chosing the assistant pricnipal, the site principal made it known to three of the committee members, he had no intention of hiring a women.I was also told by one of the members of the hiring committee that this is a man's job and therefore will go to a man, as a man can handle young men better than women. The principal hired a gentleman from a school district with no experience. Each of the ladies including myself have had administrative experience. Does this fit the definition of discrimination?

Re: discrimination based on sex

Probably. But in order to win a discrimination lawsuit you will need to prove not only that the school discriminated but also that, without the discrimination, you would have been the one who got the job.

Most gender discrimination cases fall within the jurisdiction of the Equal Employment Opportunity Commission (EEOC). Assuming yours is such a case, you will need to file a charge with the EEOC before you can bring a lawsuit. There are strict deadlines for filing such a charge, and the deadline may be as short as 180 days. I recommend consulting with an attorney in your area ASAP to assess your case and help you decide whether and how to proceed.

Good luck.
