Legal Question in Consumer Law in Texas

denied use of credit card at major clothing outlet

While visiting the state I went into a major clothing outlet, selected items and issued clerk credit card (visa) along with proper state and military ID. Clerk accepted and submitted the charge (which was approved and later redeposited to acct). While waiting for print out, a woman stating she was store mgr.(without being called) came over and viewed my ID and stated it was invalid and would not be accepted. She stated my drivers Lic. was 'invalid due the way it's cut..see how it's crooked?' My military ID was not accepted because ''this is a military id, not a valid form of state ID''

I inquired about the basis of her decision but she insisted she was the store mgr. and she had the power to make any decision she wanted to and that was the end of it. She refused to give me any info for her supv....''I'm the mgr. I've made my decision. You can make a purchase or leave the store or I can call security.'' She later called 3-4 security guards and 1 police officer when I CALMLY continued to question her basis for declaring my ID invalid. I was escorted out and the police officer (poor attitude) went back to get info for complaint dept.

You never asked a question. Stores have the right to refuse service to anyone since it is their premises. If they want you to leave the store, they have that right also. If you want to complain about this conduct, complain to the main office and talk to the president, vice president, etc., describe the person as well as you can and tell the president that you are going to tell everyone you know never to shop there and that you are going to file a complaint with the Better Business Bureau, etc. The should get you an approprate apology and make the manager's life a little more difficult. what was the question? I assume it was can she do what she did? yes and your recourse is to never shop in her store, that probably will not be in business for long.
