Legal Question in Credit and Debt Law in Texas

If I defaulted on a payday loan in Texas with an Internet loan company that was not registered in the state of Texas can they file criminal charges? It was with cashnetusa.com. The loan was in my husbands name & they've told me they are going to file fraud charges against me & charge him with trying to pass a hot check over state lines.

You probably gave them a post-dated check. The DA won't (well, shouldn't) prosecute you if the check was post-dated.

It is illegal for someone to threaten you with criminal prosecution in order to gain an advantage in a civil case (or in an attempt to collect a debt). I strongly suggest that you stop talking to these jerks on the phone. When they call, give them your address and tell them to write you a letter, and then hang up. Do it every time.
