Have I past my statute of limitations?

My father is a debris removal contractor who does work in hurricane and storm clean up. About 3 years ago in hurricane Rita, simply put, he subcontracted out some work to a group of people and they got in cahoots with a homeowner that we contracted work for.

What finally happened is that they collected payroll from us but ALSO collected the check from the customer that we had contracted with, leaving us out of the equation.

We have all the paperwork proving what they did and how the homeowner defrauded us out of our money (approx. $34k).

My father was never able to take care of this due to the extreme amount of pressure he has been under managing other things, so I'm trying to take care of this for him and begin filing a lawsuit on the homeowner, my concern is that I may have waited too long to carry this out.

If there were any tort causes of action, you may have waited too long; but for a contract action you still have time. There are several contract attorneys on this site in the Houston area -- call them and discuss your situation directly.
