Payment returned

If a payment is returned to a collection agency by a financial institution for the reason of hold on funds or NSF can they file any type of criminal charges?

Technically, they can, but it is highly unlikely because then they would not be able to collect any collection fees. Anyway, before they can file charges, they must send you a letter by certified mail, giving you 10 days to make the check good.
