I am in a different jurisdiction than Mr. Platten, and completely agree with his comments. I also presume there is no transcript, but there might be witnesses, and I would start with criminal defense lawyers in the courtroom when this happened. TC

Hello there,

I have never heard of a Judge doing this infact I believe its judicial misconduct. You need to contact the court reporter and request in writing the transcript where the judge and prosecutor were discussing who to appoint. I would be willing to bet that it was not transcribed. But if it was, you need to forward the transcript the judicial ethics commission.

Sincerely,

Erick Platten
