Legal Question in Criminal Law in Texas

Class A misdemeanor Texas Medical Board

I will be graduating from medical school in one year. When I was 17 I was arrested for a class A misdemeanor with deferred adjudication 1 year probation. I will have to present info to the Texas Medical Board. Since a class A can not be expunged would I be better served by doing nothing or seeking non disclosure? As it stands I can present my case with ''folly of youth'' If I seek non/disclosure it will appear as if I am hiding something. Would petitioning for a pardon be worthwhile? If DA means no conviction would this type of misdemeanor be pardonable?

Re: Class A misdemeanor Texas Medical Board

Even if you get a petition for non-disclosure granted, the Texas Medical Review board will still know about it. A petition for non-disclosure only seals a record from most private entities.

You could try to get a pardon, but it is very rare.

Your best bet is to just be honest and explain the situation. If you end up having a hearing, there are lawyers who can help you with that.

Even though a petition for non-disclosure won't really help you with this particular situation, it would still be a good idea to pursue it. When seeking jobs or apartments or anything like that, it would be nice if they could not see your record.

Good luck!

A class A can be expunged but not yours since you entered into a plea bargain. Contact an attorney for a non-disclosure, which may not help you since the Medical Board still has privity to the incident based on the statute.
