Legal Question in Criminal Law in Texas

My ex girlfriend stole 12000 from my account while i was in iraq

I was dating a woman for a while and we got serious and i gave her access to

my checking account in order to pay my bills while I was deployed to Iraq.

Right before i left we had a falling out and while i was gone she stole over

12,000 dollars from my account she never actually made a deposit to the

account only withdrawals. I would like to know what I can do to get my

money back, and isn't stealing a certain amount of money grounds for jail

time?

From the information you have given, you need to go to the police and make a report and possibly take out a warrant on her. If you have never given her permission at all to use the money as her own money, but only to pay your bills, then she has committed a crime. I believe you have stated that you both had problems right before you left for your deployment, did you tell her that she was not to do anything with your account? If so, and your ex-Girlfriend somehow retained your account information then she has committed a crime. You also need to contact your bank and follow their procedures for theft, etc. For instance, if your ex-Girlfriend has written checks and forged your signature, that's also forgery. I would need to know more information to better analyze the situation. Most attorneys do not charge for a consultation, especially by telephone or E-mail, I suggest you contact any of us for further discussion. You can also sue her in civil court, but people like her usually do not have money to pay a judgment even if you win. I find the best way to scare and actually make them pay through restitution is by going through the criminal court system, where the D.A. or the Solicitor prosecutes the case criminally. If I can be of service to you, please let me know. Thank you for serving our country.
