Legal Question in Family Law in Texas

If I have an 8 month old baby and am leaving the father,can I take the baby out of the country?I have to go back to work and it is overseas. We are not married. Would I get in trouble for kidnapping if I don't ask for his consent? We are in Texas

My guess is that you haven't yet applied for a passport. Do that, and you'll find out what the (State Department) restrictions are. They won't give you a passport for the child unless you get the father's signature, or are willing to swear that you don't know where he is.
