Legal Question in Family Law in Texas

Assett division in divorce

Filed for divorce in sept 06. We sold a rental house 5yrs ago, i applied money to credit cards (which were in my name) 8 wks after i filed he had a stroke - no med ins - we have a court date on june 27. All i asked is that he refinance house to get out of my name and give me 1/2 equity. He also owns own business which i am not touching. He is telling me that he cant get refinanced due to medical bills and that when we go to court his offer is that i take what money i already got from the sale of the rent house and move on or take half of his medical bills and we split everything else. My name is nowhere on hospital bills - he put divorced on papers at hosp. ? Is: can i be legally liable thru the court for his medical bills that occured after i filed and will the judge order the house to be sold and split if we go to court without a settlement? I am northeast texas.

In a nutshell, all property and debts acquired during the marriage belong half to you and half to him. Until you divorce you are still married. That said, there are numerous ways to negotiate reasonable alternatives. Bluntly, with all of the assets and debts you describe, it is foolish to go forward without an attorney.
