Legal Question in Family Law in Texas

child custody

My ex-wife and I share custody of our 4 year old daughter. I have the right to decide the child's primary residence. If we agree in writing to permit the child to spend 5 months with her mother in Montana, can this be held against either parent in regards to abondonment or neglect?

Re: child custody

Based on your information, no.

However, be aware that if the child leaves Texas for 6 months, then the mother can move the case to another state.

If you want to, the two of you can enter into a written agreement and file the agreement with the court. I would recommend that you hire an attorney to help you with the wording of this legal document.
