Legal Question in Family Law in Texas

child custody

I am 21 years old and about to go through a divorce. My daughter is almost two and I have been a stay at home mom since she was born. I love her with all my heart and I want full custody of her. Can the father get custody since he is more financially stable? He has a history of drug arrests.

Re: child custody

Financial stability is not the test considered by the court for custody. It's not likely that you would get full custody if you mean to the exclusion of the father. Mothers are usually granted possessory conservatorship and fathers are usually granted visitation. You would have to make the court aware of facts (not what you say, but evidence) to keep the father from visiting the child. Good Luck.
