Legal Question in Family Law in Texas

I went to court 7 years ago to have my daughters last name changed and the father taken off of her birth certificate. Her bio father has never had and does not want anything to do with her. my husband would like to give her his last name. How can we add his name to her birth certificate? Will we have to go thru the adoption process or is there an easier way. thanks Angelia Potter

If he does not want to create a permanent legal relationship with her, you can initiate the same name change process you did last time. Just as before, you will have to notice him of the name-change petition. This will have no legal effect, except to change her name.

If you do want to create a legal relationship of father and daughter, you will file to terminate the father's parental rights, and petition for a stepparent adoption for your husband. The termination and adoption are procedurally more complex, even with dad's consent, so you should retain an attorney.
