Legal Question in Family Law in Texas

My custody agreement states that my daughter's father can designate any competant adult to pick up my daughter for his time. He lives in ND, as I am in Texas. His mother is just showing up to pick her up.. yet I've not heard from him, nor have I been told that he is having her pick up our daugher. Do I have to let her go without being told by him that he is designating someone else to pick her up? My daughter, 5 years old, doesnt want to go with his mom...

The key is that HE DESIGNATES. This isn't the same as somebody showing up and saying "Dave sent me."

Don't turn this child over to any relative unless Dad steps up and DESIGNATES.
